New 2017 E-Verify Requirements for Tennessee (TLEA)

New TLEA Requirements Ensure a Legal Workforce

Beginning January 1, 2017, all Tennessee employers with 50 or more employees will be required to use the E-Verify system to confirm employment eligibility. The new law will eliminate the option of document retention in favor of the mandatory use of E-Verify. If employed by a Tennessee employer, employees are included whether inside or outside Tennessee.

The Tennessee Lawful Employment Act (TLEA) requires all employers in Tennessee to demonstrate that they are hiring and maintaining a legal workforce by:

  1. Enrolling and verifying the employment eligibility of all newly hired employees through the E-Verify program
  2. Requesting all newly hired employees and “non-employees” to provide one of the following identity and employment authorization documents prior to the employee performing any work:
  • Valid Tennessee driver’s license or photo ID
  • U.S. government issued certified birth certificate
  • Valid U.S. passport (must be unexpired)
  • Citizenship certification (N560 or N561)
  • Certification of naturalization (N550, N570, or N578)
  • U.S. citizen ID card (I-197 or I-179)
  • Valid alien registration documentation or other proof of current immigration registration recognized by the United States Department of Homeland Security (must contain individual’s complete legal name and current alien admission number or alien file number)
